Cleveland Boy Shot By Police - Not everyday justice is served rightfully. The latest news comes from Cleveland where a 12-year old boy had been shot to death by a responding officer. According to a report by CNN, the boy's death is entirely his fault as he reportedly failed to "exercise due care."

For those who have yet to hear about the story behind the Cleveland boy shot by police, the boy has been identified as Tamir Rice. Rice was shot on Nov. 22 by a rookie cop, Timothy Loehmann. Loehmann along with his partner, Frank Garmback, responded to a 911 call at a recreation center where Tamir was playing with a pellet gun. Within two seconds of arriving at the scene, Loehmann open fired on Tamir. The next day, Tamir died in the hospital due to injuries in "a major vessel, intestines and pelvis."

The family of the Cleveland boy shot by police have filed a wrongful death lawsuit. This has been responded by the city of Cleveland claiming Tamir was to be blamed for his own death. The 41-page response released Friday claims that Tamir's injuries and that of his sister who rushed to the scene after seeing his brother being shot "were directly and proximately caused by the failure of Plaintiffs' decedent to exercise due care to avoid injury."

As for results on autopsy done on the Cleveland boy shot by police, the Cuyahoga County's medical examiner has ruled Tamir's death as a homicide. Even with the response from the city of Cleveland, the family attorney for Tamir Ricce, Walter Madison, stands by his clients with the wrongful death lawsuit.

"I do believe that a 12-year-old child died unnecessarily at the hands of Cleveland police officers and I do believe that certain officers shouldn't have been entitled to wear the uniform," shared Madison in a report by Daily Mail.
